Motion/Recommendation:

1. Adopt the Resolution vacating and abandoning a portion of a public right-of-way known as Starwood Drive, being more particularly described as the south 653.95 feet of Starwood Drive right-of-way lying in Section 31, Township 21 south, and Range 31 east of Seminole County; or

 

2. Deny adoption of the Resolution vacating and abandoning a portion of a public right-of-way known as Starwood Drive, being more particularly described as the south 653.95 feet of Starwood Drive right-of-way lying in Section 31, Township 21 south, and Range 31 east of Seminole County; or

3.   Continue the request to a time and date certain.

Background:

The Applicant has petitioned the County to vacate a portion of Starwood Drive right-of-way, being described as the south 653.95 feet of Starwood Drive lying in Section 321, Township 21 south, and Range 31 east of Seminole County. 

 

The subject south 653.95 feet of Starwood Drive provides access to four (4) properties. The property owners are requesting to vacate that portion of public right-of-way and create a private road easement in order to install an entrance gate to prevent loitering and the illegal dumping of trash and debris. A private road ingress/egress easement has been provided for the benefit of all properties accessing the south 653.95 feet; as well as a utility easement for the benefit of Duke Energy.

 

The Applicant has provided letters of no objection from all applicable utility companies as well as the Florida Department of Transportation (FDOT); Public Works also has no objection to the requested vacate.

 

This request complies with the requirements for vacating a right-of-way under Section 35.184 of the Land Development Code and the authority of Sections 336.09 and 336.10, Florida Statutes.

 

Staff Recommendation:

Recommend the Board of County Commissioners adopt the Resolution vacating and abandoning a portion of a public right-of-way known as Starwood Drive, being the south 653.95 feet of Starwood Drive right-of-way lying in Section 31, Township 21 south, and Range 31 east of Seminole County.
