Approve and authorize the Chairman to execute a Purchase Agreement and Holdover Agreement related to Parcel #104 for 0.797 ± acres of land between Tammy G. Abramson, Karen S. Mahoney, Deborah A. Haskins f/k/a Deborah A. Beaudoin & Sandra J. Jones and Seminole County for early acquisition of property needed for the Orange Boulevard Improvement Project (5604 North Road, Sanford, Florida 32771, Tax ID #24-19-29-300-004C-0000) for $381,680.00, as full settlement of all claim for compensation from which Seminole County might be obligated to pay relating to the parcel. Background:

This parcel (#104) has been identified for early acquisition as part of the Orange Boulevard Improvement Project.  The owners (Tammy G. Abramson, Karen S. Mahoney, Deborah A. Haskins f/k/a Deborah A. Beaudoin & Sandra J. Jones) of the property located at 5604 North Road, in Sanford, Florida, have agreed to sell and convey this property to Seminole County for the sum of $381,680.00, inclusive of all fees and costs.

 

The property is improved with a single family residence situated on 0.797 ± acres of land.  The Agent Price Estimate of probable selling price was $286,000.00.  The County’s incentivized offer amount was for $378,430.00.  The final negotiated price was for $381,680.00, inclusive of all fees and costs.  This proposed settlement amount is reasonable under the circumstances inherent in the condemnation process.  The main rationale for approval of this settlement is cost avoidance.  If this acquisition must proceed to condemnation, litigation costs and the costs of the County’s appraisal and to pay for the owner’s appraisal and other expert’s fees on both sides would likely exceed the additional settlement funds proposed to be paid.  This is a whole acquisition and the owner will need to relocate.

 

Additionally, this project is not scheduled to start for approximately 2 years, so this early acquisition includes a Holdover Agreement allowing the owner to stay in the residence for 2 years when the project construction is scheduled to begin.

Staff Recommendation:
Staff recommends the Board approve and authorize the Chairman to execute a Purchase Agreement and Holdover Agreement related to Parcel #104 for 0.797 ± acres of land between Tammy G. Abramson, Karen S. Mahoney, Deborah A. Haskins f/k/a Deborah A. Beaudoin & Sandra J. Jones and Seminole County for early acquisition of property needed for the Orange Boulevard Improvement Project (5604 North Road, Sanford, Florida 32771, Tax ID #24-19-29-300-004C-0000) for $381,680.00, as full settlement of all claim for compensation from which Seminole County might be obligated to pay relating to the parcel.
