Background:

In 1989, Seminole County acquired an exclusive drainage easement from A. Duda & Sons, Inc.  A. Duda & Sons, Inc. wishes to enter into a utility easement agreement with the City of Oviedo.  A portion of this proposed utility easement agreement encompasses the easterly 8.5 feet of the County’s 60 feet exclusive drainage easement.  Therefore, consent from this Board is needed to allow for the use of the easterly 8.5 feet of the County’s exclusive drainage easement for utility purposes as provided for in the First Amendment to Drainage Easement.  Staff has worked with A. Duda & Sons, Inc. on this requested amendment.

Staff Recommendation:

Staff recommends the Board approve and authorize the Chairman to execute a First Amendment to Drainage Easement modifying the use of an existing exclusive drainage easement and adding utility rights over a portion of the existing exclusive drainage easement.
